On 29th January 1998, the Harbours and Airport Committee made an Act delegating certain of its functions under the Air Navigation (Jersey) Order 1972.

 

The terms of the delegation were recorded in an Act of the Committee as follows -

 

                “12.   The Committee, having considered a report from the Airport Director, in pursuance of Article 36A of the States of Jersey Law 1966, as amended, decided with immediate effect, to delegate to the Airport Director certain functions under the Air Navigation (Jersey) Order 1972, as follows -

Function delegated/ scope of delegation:

(i)      Article 37 - the authority to grant an exemption to Article 37 to permit parachute drops, provided that they are in accordance with the arrangements agreed between the Harbours and Airport, Defence and Tourism Committees (copy attached); this permission to be given in writing;

 

(ii)     Article 66 - the authority to permit balloons, kites or airships to be flown; this permission to be given in writing;

 

(iii)    Article 67 - the authority to grant an exemption to Article 67 to permit helicopters to fly from or land at other places other than Jersey Airport.

All exemptions permitted or refused were to be notified to the Committee at its next meeting following the granting or refusing of an exemption.

 

The Greffier of the States was requested to arrange for this Act to be presented to the States for information.

PARACHUTING GUIDELINES

 

Note:      This Committee Paper replaces the one published as part of “States of Jersey Law 1966, as amended - delegation of functions: air navigation” (R.C.12/98).

 

Local conditions - civilian parachuting

 

The Harbours and Airport Committee agreement for local civilian parachuting in accordance with Civil Aviation Authority regulations, as set out in CAP 660, is listed below -

 

                (a)     By agreement of the Harbours and Airport Committee, the Defence Committee, the Tourism Committee and with notice being given to the appropriate Connétable, parachuting may be permitted in Jersey between 1st September (excluding Battle of Britain week) and 30th April, subject to tidal conditions, weather conditions and daylight.

 

                (b)     Parachuting may take place in a dropping zone on St. Aubin’s Beach defined as a 500 metres diameter circle lying between the sea wall, the sea waterline, between the Woodbine slip and 250 metres east of the Tower slip. This area is for student parachuting including tandem. The area will contain a 250 metres circle designated as the target, with overshoots on three sides.

 

                (c)     All parachuting shall take place in accordance with the current Civil Aviation Authority CAP 660 Operational Manual under the laid down weather conditions.

 

                (d)     A suitably powered and equipped safety boat, operated by properly trained staff will be positioned adjacent to the drop zone. Inshore rescue services and appropriately equipped ambulance services will be notified of the intended parachuting programme. Ground to air radio contact will be maintained throughout parachuting and the aircraft pilot will monitor the full parachute descent before completing the dropping detail.

 

                (e)     All parachutists will be equipped with life jackets and will be briefed on their use.

 

                (f)      The parachuting programme will be supervised by a BPA Advanced Instructor who will appoint appropriately qualified staff, fully briefed to supervise the drop zone and emplaning area. He will ensure that all equipment required, including ground to air radio, is fully serviceable, that all parachuting is in accordance with CAP 660 and that all jumpers are briefed and checked prior to emplaning. He will also ensure that the access via the slipway is kept clear and that spectators or members of the public remain clear of the target area. Also, that the target is placed to remain clear of minor obstacles such as vessels and equipment placed on the beach.

 

                (g)     All flying in support of parachuting shall be carried out in accordance with CAP 660, so far as is practicable and safe. All climbing to altitude for the purposes of parachuting shall be carried out over St. Aubin’s Bay and not over land. The aircraft is equipped with Mode C transponder and climbing, dropping and descending is carried out under the supervision and permission of Air Traffic Control.

 

                (h)     An application for a parachuting programme or training course shall be made 28 days before the start of the event. After permission has been granted, a notice shall be published in the Jersey Evening Post and through other media, to advise the public of the time and duration of the event.

 

                (i)      An administrative charge may be made for applications and a charge may be levied if the States Police decide that full policing of the dropping zone becomes necessary.

 

                (j)      Notwithstanding any permission being granted, the Airport Authority may vary the conditions or suspend or cancel the permission if the safety of aircraft or persons involved are considered to be at risk or if the guidelines above are not adhered to by the organiser or participant.

 

Local conditions - military parachuting

 

All military parachuting shall be carried out in accordance with the appropriate military parachuting procedures after agreement to the date, time, venue and weather conditions appertaining to that specific military parachuting exercise. These exercises may take place throughout the year.
